When you read the proposed regulations from Massachusetts, you get a headache trying to figure out how they will deal with the apparent inconsistencies and discrepancies in the law.
McDermott Will & Emery has released a White Paper that helps laymen understand the code. Discussing The Commonwealth of Massachusetts Department of Public Health’s (the Department) release of the Pharmaceutical and Medical Device Manufacturer Code of Conduct Regulations (the Proposed Regulations) that set forth the requirements for pharmaceutical and medical device manufacturers to comply with the Commonwealth’s pharmaceutical and medical device disclosure law (the Massachusetts Disclosure Law). The White Paper discusses in detail the comparisons of some of the more significant Massachusetts Disclosure Law requirements and highlights the key corresponding provisions of the Proposed Regulations.
This is the best summary I have seen thus far of a very complicated regulation. It will be especially useful if you are planning to attend the public hearings:
