The Rise of Stand Alone State Attorney Healthcare Enforcement Webinar

On December 19, 2013, from 1:00PM – 2:00PM EST is the following program: “The Rise of Stand-Alone State Attorney General Health Care Enforcement Actions and the Risk to Medical Device Companies“.

According to the AdvaMed, the program will address the rise of stand-alone state Attorney General enforcement actions against health care companies, including medical device companies.

The program states: “At present, that rise is based on state AG’s who are pursuing actions, independent of the DOJ, on state specific legal theories under consumer protection, unfair trade practice and other statutes. This program will address some of the novel legal theories and statutes that have been pressed by the states against medical device and other healthcare companies, including recent results in some of these cases.

The program will also discuss a current trend in the state AG enforcement of pharmaceutical companies which appears inevitably headed toward medical device companies as well, namely state AG’s opting out of national federal False Claims Act settlements and bringing their own state actions, and will include discussion of some recent successes by opt out states, particularly in Texas and Louisiana, and the use of contingency fee lawyers by certain state AG’s in these enforcement actions.”

Speaker: Jeremy Sternberg, a partner in Holland & Knight’s Boston office.
