Massachusetts Gift Ban: Kicking the Can

After months of discussions the Massachusetts Department of Public Health will propose to the Public Health Council regulations in compliance with Chapter 305 Section 111N, the Pharmaceutical and Medical Device Manufacturer Conduct. The Department will not propose emergency regulations at the December 10 meeting.

The Department will give an informational briefing to the Public Health Council and then proceed to release the proposal for public comments. Public hearings will be held during the public comment period.

They will not be taking public comments at the meeting but will be discussing the hearing procedure to gain public input for implementation of the rules of this law.

According to the FDA Law Blog: On November 26, 2008, the Massachusetts Department of Public Health delayed plans to propose emergency regulations that would implement the state’s recently enacted pharmaceutical and device marketing law at a December 10 meeting of the Public Health Council. 

 

A pair of hearings will be held in January 2009 to address issues surrounding the law with the earliest possible vote on proposed regulations taking place in February
